Workmen employed by Newtown Borough Council were undertaking emergency road repairs which compound digging deep holes in the road. The road had not been repaired for a few years, and was in a bad state of repair. on that point were re billetntial properties on one side of the road, and business exposit on the other side. The following events have now occurred.

Alex, an elderly resident who lives alone, had no voltaic light in his house as a result. He slipped and fell over in one of his rooms in the darkness and suffered injuries, which required a stay in hospital for two weeks. After returning home, he found travel difficult, and needed to use a stick to get around. He also now has to pay for a home serve well to do his shopping and housework, which he did not need to do before the accident.

The incident also affected Cool sess Ltd, a drink factory on the opposite side of the road, where the evening shift was still in progress. The power cut caused a malfunction of the machinery on the production line. This needed a repair, which cost £10,000.



The company stated that they also lost a profit of £50,000 for the two days of the power cut, and a supercharge day while the machinery was repaired. They said that this related to the loss of the drinks that were in production when the power went off, plus the profit for the total anatomy of drinks that they could have produced in that time.

Alex and Cool Cola Ltd are twain arguing that Newtown Council is to blame for these incidents, and they would each like to bring a claim in negligence against the council.
